The Other Line – Terms of Service (Updated & Expanded)

1. Introduction

These Terms of Service (“Terms”) govern the rental and use of The Other Line (“TOL”) audio guestbook (“Equipment”) by the client (“Client”). By booking, paying for, or using the Equipment, the Client agrees to all terms outlined herein.


2. Payment & Deposit

2.1 A payment equal to 50% of the total rental cost is required at booking.
2.2 This initial payment is non-refundable and serves as a reservation deposit.
2.3 Remaining balances must be paid according to the Service Contract.


3. Client Responsibilities

3.1 Upon delivery or setup, the Client must open and test the audio guestbook on the day of delivery to confirm it is functioning correctly.
3.2 Failure to open and test the Equipment on the day of delivery waives the Client’s right to any refund, reimbursement, replacement, or claim of non-performance should the Equipment later be found inoperable.
3.3 The Client is responsible for ensuring proper setup, including secure wiring, correct connections, and use of a functioning power source.
3.4 TOL is not responsible for unrecorded messages caused by improper setup or failure to test the Equipment.


4. Equipment Condition & Vintage Disclaimer

4.1 Many of TOL’s phones—including the Eleanor, Daphne, Kennedy, Lana, and Madeline models—are vintage (20+ years old).
4.2 While TOL carefully sources phones in the best condition available, minor cosmetic imperfections such as small scrapes or discoloration may be present due to age.
4.3 Cosmetic imperfections do not qualify for refunds or exchanges.
4.4 Clients with concerns about condition are encouraged to contact TOL with questions prior to booking.


5. Replacement Policy for Damaged-on-Arrival Equipment

5.1 If the Equipment arrives damaged, TOL will replace it at no cost to the Client, provided the Client opened and inspected the shipment on the day of delivery.
5.2 If TOL is unable to provide a replacement in time for the event, the Client will receive a full refund.
5.3 Replacements are only guaranteed if the Client opens and tests the Equipment upon delivery.
5.4 TOL is not liable for delays caused by UPS or any shipping carrier.


6. Liability & Indemnification

6.1 The Client agrees to indemnify and hold harmless TOL, its representatives, employees, and affiliates from any and all liability related to the Client’s event, during or after the event.
6.2 This indemnification covers any liability associated with the Client, the Client’s guests, or the use of audio taken at the event.
6.3 The Client assumes full responsibility for any injury, incident, or complaint arising from the use of the Equipment during the event.


7. Damage, Loss, and Misuse

7.1 The Client is responsible for any damage or loss to the Equipment caused by misuse, mishandling, neglect, or actions of the Client or event guests.
7.2 The Client acknowledges they may be charged up to $1,000 for damage or replacement costs, billed to the card on file.
7.3 Normal wear from standard use is not considered damage.


8. Event Date, Service Period & Delivery Window

8.1 The service period is defined as the event date listed in the Service Contract.
8.2 The Equipment will be shipped to the Client and typically delivered 2–5 days before the event.
8.3 The package must be opened and tested on the day it arrives.
8.4 Failure to test the Equipment immediately releases TOL from responsibility for unrecorded messages or event-day malfunction, as replacement availability is time-sensitive.


9. Date Change Policy

9.1 Requests to change the event date must be submitted no fewer than 30 days before the original event.
9.2 Changes are subject to availability and require a new Service Contract.
9.3 If no date is available, the non-refundable deposit is forfeited and the rental is canceled.


10. Return Shipping & Late Fees

10.1 The Equipment must be shipped back to the return address provided by TOL within 1–2 business days after the event.
10.2 Late returns incur a $30 per-day fee, automatically charged to the card on file.
10.3 Audio files from the event will not be released until all outstanding fees are paid.
10.4 The Client is responsible for securing the Equipment properly when returning it.


11. Limitation of Liability

11.1 TOL is not liable for indirect or consequential damages, including lost recordings due to setup error, failure to test, environmental conditions, or carrier delays.
11.2 TOL’s total liability shall not exceed the amount paid by the Client for the rental.


12. Agreement

By booking or using The Other Line's services, the Client confirms they have read, understand, and agree to all Terms listed above.
